On Tuesday, October 24, 2023, a chilling announcement was made by Damian Williams, the United States Attorney for the Southern District of New York. He, along with James Smith from the FBI and Edward A. Caban from the NYPD, revealed a Complaint against Diaz. What’s Diaz accused of? Opening fire outside a Bronx deli, leaving one victim nursing a bullet wound in their arm.

Diaz, an all too familiar face to law enforcement, was arrested and presented before U.S. Magistrate Judge Katharine H. Parker. The details of his alleged crime are enough to send shivers down your spine.

What does Williams have to say about this? “As alleged, Miguel Diaz — who was previously convicted of reckless endangerment — fired a bullet outside a deli in the middle of the day at the corner of Edward L. Grant Highway and Jesup Avenue in the Bronx. Thanks to the swift action of our law enforcement partners and the prosecutors of this Office, Diaz will now be held accountable for his alleged reckless and violent actions.”

Caban, equally disturbed, added: “The dedicated men and women of the NYPD, who have accomplished a 26 percent reduction in shootings so far this year in New York City, are still battling a scourge of gun violence that threatens everyone who lives, works, and visits here. And just as New Yorkers expect and deserve, we and our law enforcement colleagues vow to keep working tirelessly to investigate and arrest anyone brazen enough to carry and shoot an illegal weapon on our streets.”

Now let’s delve into the gritty details:

On October 4, 2023, at around 6:00 p.m., Diaz was caught on surveillance video walking southbound to the corner of Edward L. Grant Highway and Jesup Avenue. He lurked outside a Bronx deli for several minutes. As an unsuspecting victim emerged from the deli, Diaz made his move. He approached the victim from behind, pulled out a firearm, and fired a shot. Diaz then pocketed the weapon and fled the scene.

What’s more? NYPD officers found a 9mm FC Luger shell casing at the scene. And here’s the kicker: Diaz wasn’t even allowed to possess ammunition due to a prior felony conviction for reckless endangerment. This man had only been released from state custody four months earlier after serving nearly five years in prison.

Now, Diaz is facing a charge of possession of ammunition after a felony conviction, which could see him locked away for up to 15 years.

But remember, while this news might be shocking, Diaz is still presumed innocent until proven guilty.
