The Michigan Court of Claims will hear numerous lawsuits pertaining to the 2020 Edenville Dam catastrophe. The Michigan Court of Appeals unanimously decided that the case should proceed.
The Edenville Dam update will continue
The Court of Claims will review the cases in light of the decision to decide whether the state bears some responsibility for the disaster of Edenville Dam. According to the claims, the Michigan Department of Natural Resources and the Department of Environment, Great Lakes, and Energy prioritized environmental conservation over public safety.
The cases, as stated in the judgment for the Edenville Dam incident, contend that the government is to blame for illegally “taking” the lost property and that the state failed to take acts that could have prevented the dam breach. Another name for it is “inverse condemnation.”
Following Judge Kristina Robinson Garrett’s opinion, the locals who suffered property losses due to the flood from Edenville Dam should have a chance to present their case.

Michigan Supreme Court’s decision for Edenville Dam
The Edenville Dam’s owner, Boyce Hydro, who has declared bankruptcy, is the only party the state holds accountable. According to a statement from the Attorney General’s office, state regulators who were performing their duties shouldn’t be held liable.
The statement read, “The State maintains that the evidence not only refutes the plaintiff’s account of events but also demonstrates that the private Edenville dam operator, not the state regulatory bodies, was to blame for the fall of the dam.
The attorney general’s office claims it is deciding what to do next. To the Michigan Supreme Court, an appeal might be made.
