An ex-con who served two prison sentences on Robbery convictions is back in jail.
Marquise Smith, who lives at 100 Terrace Avenue in Hempstead, was remanded today by Judge Marie McCormack after his arraignment on five Felony Gun charges along with reckless endangerment for his alleged involvement in a shooting in August.
Police say Smith, 37, was the shooter who discharged a loaded gun at a “large gathering of people” as they stood together on Evans Avenue across the street from the Hempstead Parkside Gardens housing project August 26, 2023, around 11:30pm. Police rushed to “multiple Shotspotter alerts” on that block.
Investigators say they recovered six shell casings at the scene. Video surveillance, they say, led to a warrant for Smith’s arrest.
Last night, they caught him.
Smith was driving down Jackson Avenue in Hempstead in a black 2020 Acura sedan. He parked the car at 5:45pm by a laundromat. Then he got out.
Police were watching.

When Smith saw them, say cops, he ran.
One cop who was there says Smith “pushed the Officers while trying to flee but was unable to pass them.” Police say that after they got Smith on the ground, in handcuffs, they searched him and found a loaded black Taurus 357 revolver with 5 bullets in his right pocket. The gun’s serial numbers had been removed — it was a ghost gun.
Smith was charged with Felony criminal possession of a loaded gun on both dates, Felony possession of a ghost gun, Felony gun possession, Felony gun possession with a previous gun conviction, a Felony charge for reckless endangerment, and resisting arrest.
Smith pleaded Not Guilty.
Can’t blame him. On the three C Felony charges alone for 2nd degree gun possession under New York Penal Law 265.03 he could get 15 years.
Smith is scheduled to appear in court again on Friday in Mineola.
